Terms of Use (EULA)

These Terms of Use ("Terms") are a binding agreement between you and Trakwyze ("we," "us," or "our"). The Trakwyze mobile applications (iOS and Android) and related backend services are the product ("Service"). The website at trakwyze.com provides marketing information and these legal documents only. By downloading the app, creating an account in the app, or subscribing, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Trakwyze provides fitness tracking, nutrition logging, progress analytics, and AI-generated coaching content ("Kai"). The Service is for general wellness and educational purposes only. It is not medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting or changing any diet or exercise program, especially if you are pregnant, nursing, have a medical condition, or take medication.

You assume all risks from physical activity and dietary changes you make based on app content. Stop exercising and seek medical attention if you experience pain, dizziness, or other adverse symptoms.

• You must be at least 13 years old (or the minimum age required in your country).
• Accounts are created in the mobile app. You must provide accurate registration information and keep your login credentials secure.
• You are responsible for all activity under your account.
• We may suspend or terminate accounts that violate these Terms or applicable law.

Premium unlocks advanced features on mobile (e.g. AI workout roadmaps, smart meal suggestions, and enhanced coaching). Premium is offered as an auto-renewing subscription through the Apple App Store or Google Play, processed by Apple or Google (not charged directly by us).

• Plans: Yearly and monthly subscriptions (product IDs may include com.trakwyze.app.premium.yearly, com.trakwyze.app.premium.monthly). Exact titles and prices are shown in the purchase sheet before you confirm.
• Free trial: Where offered, a 7-day free trial may apply to eligible yearly plans. If you do not cancel before the trial ends, you will be charged the subscription price shown at purchase.
• Automatic renewal: Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current billing period.
• Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price.
• Manage or cancel (iOS): Open Settings → [your name] → Subscriptions, select Trakwyze, and choose Cancel Subscription or change plan.
• Manage or cancel (Android): Open Google Play → Profile → Payments & subscriptions → Subscriptions → Trakwyze.
• Restore purchases: Use "Restore purchases" on the paywall if you reinstall the app or switch devices (same Apple ID or Google account).
• Refunds: Refund requests are handled by Apple or Google under their policies; we cannot issue store refunds directly.
• Free trial forfeiture: Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription, where applicable under store rules.

Access to the Service requires an active subscription purchased through the App Store or Google Play, unless otherwise stated in-app. See our Pricing page for an overview.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not:

• Copy, modify, reverse engineer, or redistribute the app or its content.
• Use automated means to scrape or overload our systems.
• Upload unlawful, harmful, or infringing content.
• Impersonate others or share account credentials.
• Use the Service for emergency or clinical medical decisions.

Kai and other AI features produce suggestions that may be inaccurate or incomplete. You are solely responsible for evaluating outputs before acting on them. Do not rely on the Service as a substitute for professional advice.

You retain ownership of data you log (workouts, meals, messages, etc.). You grant us a worldwide license to host, process, and display that data to operate and improve the Service, as described in the Privacy Policy. You may delete your account and request data removal as explained there.

Trakwyze name, logo, software, and design are our property or our licensors'. These Terms do not grant you any rights to our trademarks except as needed to use the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR SPECIFIC FITNESS RESULTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply. You agree to resolve disputes in the courts located in Delaware, unless applicable law requires otherwise.

We may update these Terms. We will post the revised version on this page with a new "Last updated" date. Material changes may also be communicated in-app or by email where required. Continued use after changes constitutes acceptance.
